LANSING, Mich. -- The Michigan Court of Appeals has overturned the 2006 conviction of a mother sentenced to life in prison for killing her 7-year-old daughter.Donna Yost, 48, of Bay City, was found guilty of giving her daughter Monique a fatal dose of antidepressant medication in 1999 to block an investigation into possible sexual abuse of the girl by others.The appeals court released an opinion Friday ordering a new trial.The court said a Bay County trial judge should have let Yost present evidence about her limited intellectual functioning and call a toxicologist as a witness.The court adds that the judge should have done a better job limiting testimony about the defendant's involvement with Child Protective Services.Back in 2006, when Yost was convicted by a jury panel consisting of 10 women and two men, she turned to them and said, “You’re wrong.”
