Jury Awards Dow Chemical $61M In Patent Ruling 6-15-2010

Dow Chemical has won a lawsuit against a Canadian chemical company after Dow claimed they had infringed upon two of its patents.
Bloomberg News reported a judge ruled in Dow’s favor and awarded the Midland-based company $61.7 million after a jury found Nova Chemicals Corp. at fault for copying Dow’s especially strong plastics used in various items.
Dow’s lawyer said the company was infringing on Dow’s property rights by making the plastics and went on to insinuate Nova did it on purpose.
Nova’s lawyer refuted Dow’s claim of patent infringement by saying Dow’s patents were invalid due to missing data.
Dow filed the suit in 2005 in federal court and Tuesday’s ruling came after a two-week trial in Delaware.
