Lawyer Seeks To Drop Charges In Baby's Death 7-27-2010

The lawyer for the Williams Township teen accused of killing her newborn is asking a judge to toss out two charges in the case.
He’s asking that the second-degree murder and involuntary manslaughter charges be nullified, citing insufficient evidence.
Nicole Kipfmiller also faces one count of removing a dead body.
Investigators said 19-year-old Nicole Kipfmiller threw her baby in a Dumpster outside a convenience store in December.
During Kipfmiller's pre-trial hearing in March, the doctor who performed the baby's autopsy took the stand and said the infant was born alive and was breathing.
Kipfmiller has previously stated that the baby didn't cry or move when it was born.
A judge will consider the motion one week from Tuesday.
