Driver In Fatal Motorcycle Crash Appears In Court 10-07-2010

A 40-year-old Linwood woman was in a Bay City courtroom Thursday facing charges in connection to a fatal car-motorcycle collision.
Michelle L. McQuarter was arraigned last week by Bay County District Judge Timothy J. Kelly on single felony counts of operating a motor vehicle while intoxicated causing death, vehicular manslaughter and operating a motor vehicle while intoxicated causing serious injury.
On Thursday, McQuarter had her first preliminary examination. Judge Dawn Klida is expected to decide if McQuarter will be bound over for trial.
Prosecutors said McQuarter was driving south on North Huron Road when she drove into the back of a 1990 Harley-Davidson motorcycle last August.
The passenger of the bike, Cindy Lou Stolz, 52, died from her injuries. The driver, Brian M. Hecht, 44, was also hospitalized.
Hecht testified on the witness stand that he was traveling 55 mph when his motorcycle was struck from behind.
Published reports said McQuarter's blood alcohol level registered 0.29 percent; the legal limit in Michigan is .08 percent.
