Trial Date Set In TeenÂ?s 2009 Taser Death Lawsuit 2-17-2011

A trial date has been set in the lawsuit stemming from the Taser-related death of a Bay City teen.
Vernon R. Johnson of Feiger and Feiger, the attorney for the family of Brett L. Elder, was set to meet with Bay City attorney Kenneth G. Galica, of Livonia, to work out a settlement.
If no agreement can be reached, the case will go to trial Oct. 4.
The 15-year-old Elder died after police used a Taser on him in 2009 while at a party on South Catherine.
Prosecutors claim the teen was intoxicated and combative, and declined to press charges. But witnesses claim Elder was already handcuffed when police used the Taser.
An autopsy performed by Dr. Kanu Virani, a forensic pathologist, found a two-part cause of death for Elder: "alcohol-induced excited delirium" and "application of an electromuscular disruption device."
