Judge: School Worker Pay Cut Unconstitutional 4-04-2011

LANSING, Mich.A judge has ruled unconstitutional a state law forcing school teachers to pay 3 percent of their salary toward retiree health care.
The Lansing State Journal reported Monday that retired Ingham County Circuit Judge James Giddings said the legislature's action "is quintessentially arbitrary and unreasonable."
Giddings made his ruling Friday.
A spokeswoman for Attorney General Bill Schuette told The Associated Press that a decision hasn't been made on whether to appeal Giddings' ruling.
Another judge in February ruled unconstitutional a similar 3 percent salary provision for state employees.
The Michigan Court of Appeals later ruled the state can continue to withhold the 3 percent.
The legislation was passed in September with the money going into an escrow account pending the case's outcome.
