BAY COUNTY, MI (WNEM) -

A small-town bar in Bay County has applied for a second time for state permission to allow waitresses to go topless.

The Silver Derby, in Garfield Township's Crump, wants to offer topless waitresses for certain events like bachelor parties.

The establishment, at 506 N. Garfield, was already unanimously denied for the Topless Activity Permit after applying for it in May 2011.

On Monday, during a regular monthly board meeting, Garfield Township Board of Trustees denied the Silver Derby's second request. The recommendation is expected to be sent to the Michigan Liquor Control Commission, for final say.

The bar owner says he's trying to stay profitable in a tough economy and that the wait staff would be fully clothed during daytime business hours.

More than 50 residents spoke out during the board meeting Monday.
