Sexual assault charges dismissed in church attack

FLINT, Mich. (AP) - Sexual assault charges have been dismissed against a man who authorities say raped one woman and tried to attack another at a downtown Flint church.

Albert Haymer, 49, of Flint, was scheduled to be in District Court on Monday for a preliminary hearing on the charges, but the woman who was attacked March 27 at First Presbyterian Church didn't show up.

Defense lawyer Major White requested the dismissal.

Genesee County Prosecutor David Leyton says charges were dismissed without prejudice, meaning they could be filed again in the future.

Leyton says his office wants to prosecute the case. He says officials are seeking the woman, who is homeless, with hopes she'll testify as a witness.

Haymer is jailed on other charges.
