Murder charge reinstated against Huron Co. mother

A Huron County judge has reinstated a murder charge against a woman who prosecutors say killed her toddler son in late 2011.

The Huron Daily Tribune reports Wednesday that Circuit Court Judge M. Richard Knoblock restored charges of second-degree murder and first-degree child abuse against 29-year-old Jennifer Lynn Emerick of Sheridan Township.

The charges had been dismissed in district court last year.

County Prosecutor Timothy Rutkowski says Emerick held Donavin Cochrane facedown into his pillow, causing the 23-month-old to die by asphyxiation on Dec. 29, 2011, at the family's home.

Defense lawyer Leon Weiss says Donavin woke up with a "coughing jag" that made him throw up, and he choked on his own vomit.

The new trial date in the case is July 16.
