A man who says he was the victim of excessive force at a Michigan home for the disabled has won a key decision from a federal appeals court.
The court has reinstated a lawsuit filed by Matthew McGuire, saying a judge improperly excluded certain evidence. The court says there are enough factual disputes to let a jury decide the case.
There is no dispute that McGuire, who is mentally ill, suffered broken ribs and bruises during his time at the Mount Pleasant Center, which was run by the state until 2009. The issue is how the injuries occurred.
The state says McGuire had to be restrained at times and any force was used in good faith.
