Arizona high court to issue opinion in 2008 case

PHOENIX (AP) -

The Arizona Supreme Court is expected to issue an opinion in the case of a man sentenced to death in a Peoria triple homicide.

A jury found Robert "Bobby" Hernandez guilty of three counts of first-degree murder with aggravating factors.

At the time of the April 2008 fatal shootings, Hernandez was on parole after serving an eight-year prison sentence for armed robbery.

The state's high court heard oral arguments about whether Hernandez was denied in his request for a new lawyer and if there was sufficient evidence to support his convictions for premeditated murder.

Court documents show Hernandez broke into the home of a Peoria couple looking for his former girlfriend, who's the mother of his three children.

One of the four people shot survived and identified Hernandez to police.
