Man arrested at theater with fake CIA ID, body armor out on bond

The FBI says a man was arrested at a Michigan movie theater Tuesday night after being found with a fake CIA ID while wearing body armor and carrying a gun.

Cassidy Delavergne, 24, wasn't charged with crimes related to the gun or 34 rounds of ammunition, but he was charged Wednesday with possessing a phony Central Intelligence Agency identification card.

Delavergne has since been released on $5,000 unsecured bond Wednesday. He has also been ordered to undergo a mental health evaluation.

FBI spokesman Simon Shaykhet says police were called to the Trillium Theater in Grand Blanc Township near Flint on Tuesday night after someone noticed the vest and gun. Delavergne was watching the film "Red 2" when police arrived. Upon further investigation, more than 100 additional rounds were found in the trunk of Delavergne's vehicle parked outside.

Shaykhet declined to say whether agents believe Delavergne planned to use his handgun.  According to court documents, he wore the body armor and brought the gun into the theater because he did not want to leave it in his vehicle during the movie.

A court filing says Delavergne told an agent he displayed the phony ID to minimize concerns about his gun. Delavergne does have a concealed weapon permit, which he has had to surrender to authorities, and he's not allowed to possess any firearms while he's out on bond.

If Delavergne is convicted of impersonating a federal officer, he could be sentenced to up to five years in prison, with a $1,000 fine.
