The tragic death of a young Saginaw boy has led to a lawsuit against a local medical examiner.
Elijah Dillard, 6, passed away in March. Police say it was the result of child abuse and his father is facing murder charges.
Elijah's organs were supposed to be donated but because his body is evidence in the case, the county prevented his organs from being harvested.
Now Gift of Life Michigan is suing Saginaw County and the medical examiner.
"We're always in favor of justice being served but state law is very clear. Examiners can do their investigation but organ donation should be able to go forward," says Gift of Life CEO Richard Piotrowski.
The medical examiner says he was just trying to preserve evidence for criminal prosecution."It is my job to review anything and everything with this body to see how he suffered. That is the medical examiner's job," says Saginaw County Chief Medical Examiner Kanu Virani.
Both parties will be in court next month.
