Three suspects in 13-year-old's death make court appearance

CARROLLTON, GA (CBS46) -

The remaining three suspects in the death of Nizzear Rodriguez, 13, appeared before a judge Wednesday.

Carrollton police said someone shot the honor roll student as he slept at his grandmother's townhome early Sunday morning.

Police believe Malik Davis, 17, and Kenneth Wheat, 21, broke into the home. Police did not immediately know who pulled the trigger.

Both Davis and Wheat are charged with murder, burglary, and possession of a firearm during the commission of a felony. A judge did not grant either one bond.

Wheat knows the victim's grandmother, Alice Stout-Osorio, and would often eat at her home. After his arrest, he asked police for permission to talk with her.

"He just kept crying and saying 'I'm sorry,' and he didn't shoot him. He says 'I was not the one who shot him,'" said Stout-Osorio.

Jackquline Freeman, 24, is also charged with murder and was not granted bond. Police said she was the getaway driver.

"She told me she had nothing to do with it," said Kathy Holland, Freeman's mom.

Oleida Ward, 34, is charged with hindering the apprehension of a felon. Police said she helped Wheat and Freeman hide from police in her apartment.

A judge granted Ward a $10,000 bond.

Some of the victim's family members believe robbery was the motive behind the shooting, pointing to the fact a Playstation 3 was taken.

However, Capt. Chris Dobbs with the Carrollton Police Department said nothing had been determined.

"We want to know just as much as anybody," said Dobbs.

Stout-Osorio said her heart is broken but she hopes her grandson's murder serves as a wake-up call.

"We all just need to come together and stop the violence, stop the crimes, stop the violence; we're just killing each other," said Stout-Osorio.

Rodriguez's funeral is scheduled for Saturday, Sept. 6 at 2 p.m. at Tabernacle Baptist Church in Carrollton.

Davis, Wheat, and Freeman are scheduled back in court on Sept. 5 for a preliminary hearing.
