No criminal charges in woman's death by bus

ALMA, MI (WNEM) -

A 62-year-old woman is dead after being hit by a bus.

On Sept. 1 at 6:26 p.m. on Pennsylvania Avenue south of Maryland Street in Alma, Mildred Griffith and her husband were chasing after their dog, who had escaped their house.

Griffith tripped and fell in front of a parked Alma Dial-A-Ride bus while attempting to catch the dog.

Keith Kushion, Gratiot County prosecutor, said the bus driver was aware of the situation, and after seeing Griffith's husband catch their dog, drove forward, running over Griffith.

Her neighbor, Matthew Rodriguez lives across the street and rushed outside to help. 

"I was completely in shock. I took about 30 second to set in before I even realized what happened, and then I ran out here and [the driver] asked me to call 911," Rodriguez said.

Griffith was taken to the hospital where she later died from her injuries.

On Dec. 11, Kushion released a statement:

"I have reviewed a 47-page police report prepared by the Michigan State Police and the Alma Department of Public Safety as well as photographs taken at the scene and the video from the Dial-A-Ride camera. I addition, I have gone to the Dial-A-Ride center and observed the bus involved in the accident and the view afforded from both the driver's front windshield and front bumper mirror. As a result of this investigation, I am declining to issue any criminal charges against the driver of the Dial-A-Ride bus."

Kushion said this decision was made because of the highly unique circumstances around Griffith's death. 

"It would not be appropriate to try and impose criminal liability for this incident," Kushion said. "Whether or not there is any civil liability arising from this incident is not for my office to determine."
