Family of woman killed during police chase say trooper's punishment 'unacceptable'

Only a mangled mess was left in the aftermath of the crash that killed Jaqueline Nichols.

"I think about her every day, every day," said daughter, Tamara Nichols.

Her family says she was robbed of her life in the summer of 2014 when a trooper hit the car she was in, killing her.

"I can never have my sister back, never," said Trenace Cummings, Jaqueline’s sister.

And now, they don't think she's getting justice.

"She's gone, and he only gets what he got? No, it's not acceptable," Cummings said.

Trooper Timothy Fagin was disciplined for the crash.

According to state records, Michigan State Police proposed a 30-day suspension for Fagin.

But earlier this year, he negotiated it down to 20 days. He will serve a six day suspension and lose a vacation day.

But the other 10 days will be served only if the trooper has another offense.

Nichols family said it's a slap on the hand.

"I feel like he should have got more. He should have got suspended, and got time in prison, because had it been a civilian, that's what they would have got, time in prison," Nichols said. "It's not fair, no, it's not."

As part of the punishment, Fagin cannot work at the flint post until 2017. The Nichols family said they find very little justice in that.

"Not to me, it's not acceptable," Cummings said.

But the family says this situation is made even harder because they've never received any type of apology from the trooper or the department.

"Not even I'm sorry. Not even I'm wrong, I made a wrong judgment, I heard nothing from no one," Cummings said.

Earlier this year, Jaqueline’s family settled in a lawsuit with the state for $7.7 million.
