FLINT, MI (WNEM) -

Darnell Earley has been subpoenaed to testify before a U.S. Congressional hearing into the Flint water crisis.

On Feb. 4, Earley’s attorney, A. Scott Bolden confirmed he had accepted service of a new subpoena for a deposition on Feb. 25.

The news comes a day after Rep. Jason Chaffetz, the chairman of the House Oversight Committee, said he is "calling on the U.S. Marshals to hunt him [Earley] down and give him the subpoena".

Earley had been invited to attend the hearing on Feb. 3 that discussed the ongoing issues with lead in Flint’s water. He declined to appear. His attorney also “refused service” of a subpoena that was sent to him on Feb. 2.

Earley was the emergency manager in Flint when the city made the switch from the Detroit water system to the Flint River.

His lawyer said that while Earley is willing to appear before the committee, Earley might invoke his right to remain silent.
