Man takes responsibility for crime after another man did time

He walked free after 10 years behind bars for a crime he said he never committed.

Now is the real criminal stepping forward?

The man said he heard Omar Pouncy's story and had to clear his conscience. He told TV5 in an exclusive interview he is the one who committed the crimes 11 years ago.

Pouncy is from Flint and spent more than 10 years in prison after being convicted of a car jacking and armed robbery. He was released after a judge ruled his rights were violated during the trial.

Pouncy was forced to represent himself after a judge refused to let him hire his own attorney.

He stood by his claim he was innocent all along and now a man is claiming responsibility for the crimes.

Jaawkawa McGruder said he is the one who committed the crime pinned on Pouncy in the fall of 2004.

McGruder said he was with two others and Pouncy was not involved.

"I knew it was wrong. I understand that and that's a lot of why I'm coming forward. I know there's a lot of other people involved in it, you know, that actually suffered from what we did," McGruder said.

"I am the true person who did it, and if they have anything, you know, direct it towards me because I'm ready," he said.

McGruder spoke to TV5 with Pouncy's attorney, David Moffitt, by his side. Moffitt said he believes the statute of limitations has been reached, but McGruder ready to suffer any consequences.

"He still faces a heavy burden of possible trial and it's not over for a person in that position until it's over," Moffitt said.

The Genesee County Prosecutor's Office told TV5 a few weeks ago they plan to appeal the federal judge's decision to release Pouncy. They said they plan to retry him if necessary.
