State Supreme Court to hear more about risks of big-box lots

BAY CITY, MI (AP) -

The Michigan Supreme Court is taking a look at the risks facing shoppers, drivers and stores in big-box parking lots.

Virginia Rawluszki suffered a brain injury when she was hit by a car as she left a Menards store in the Bay City area in 2011. She later died at age 72. Her family says Menards had a duty to install signs or traffic signals to warn drivers.

Menards says the crosswalk in front of the store was an open-and-obvious danger, a key legal standard in Michigan, but a judge refused to dismiss the lawsuit. The state appeals court upheld the decision.

The Michigan Supreme Court says it will hear arguments about whether to take a full appeal from Menards or some other action. No date has been set.
