SAGINAW COUNTY, MI (WNEM) -

A man accused of driving drunk in a crash that killed his girlfriend and 4-month-old daughter had been arrested on drunk driving charges a month before the crash.

Prosecutors say Rodolfo Michael Sanchez was driving on June 24 when the car left the road at the corner of Michigan and Tulane in Carrollton Township and hit a tree.

Lindsey Drake, 30, and her 4-month-old daughter Amiliana Sanchez died in the crash. Sanchez's sister, 18-year-old Nikki Cortez, was seriously injured.

Michigan State Police confirm to TV5 that on May 29 Sanchez was believed to be drunk when he was stopped in Saginaw.

Investigators say he refused a Breathalyzer test, and while they waited for results on a blood test Sanchez bonded out.

He is facing charges under the state’s “Super Drunk” law.

Sanchez is facing two counts of OWI causing death and one count of OWI causing serious injury in connection with the crash that killed his girlfriend and his baby.
