DETROIT (AP) -

A dog rescue group says a Michigan man won't be forced to give up his dog after coming under scrutiny for posting a photo with the animal on Facebook.

Dan Tillery posted the picture of him and Diggy earlier this year to the Detroit Dog Rescue Facebook page. The photo was widely shared.

Police in the Detroit suburb of Waterford Township said Diggy was illegal because a local ordinance bans ownership of pit bulls. Police say they received complaints after the photo was posted, but the group Detroit Dog Rescue said Diggy is an American bulldog.

The Detroit News reports the case was resolved on Tuesday, with Detroit Dog Rescue saying the dog can stay.
