Two Flint men have been convicted of murdering a pizza delivery man in 2015.

Ah’quan Montray Lay, 25, and Kevin Lionel Thompson, 21, were found guilty on Monday, May 21.

They were convicted in the April 21, 2015 shooting death of 27-year-old David Ross Fuller. Fuller was on a delivery run for Cottage Inn Pizza at the time of the shooting.

Lay and Thompson were found guilty of felony murder, armed robbery, conspiracy to commit armed robbery and related firearm charges.

The defendants phoned in a pizza order to Cottage Inn Pizza and provided the address of a home they knew was abandoned, the Genesee County Prosecutor’s Office said.

The testimony revealed Lay devised the plan and gave Thompson the gun.

“As Fuller pulled into the driveway with the pizza delivery, Lay was down the street observing the scene and Thompson was hiding in a shed behind the house. All the while through the incident, Lay and Thompson were on the phone together.

As Fuller was getting the pizza out of the backseat, he observed Thompson coming from behind the house. Quickly realizing the danger he was in, Fuller hurriedly got back in the driver’s seat but Thompson was able to shoot him in the arm through the halfway opened driver’s window. Thompson then reached around through the rear door that Fuller had left open and Thompson fired at Fuller from behind fatally striking him in the neck and thigh,” the prosecutor’s office said.

Genesee County Prosecutor David Leyton said this was a tragic and sad case.

“David Fuller was just a young man trying to earn an honest living while working in a dangerous environment,” he said. “While we cannot turn back the hands of time on this case, I am glad we were able to obtain murder convictions against Lay and Thompson,” he said.

Lay and Thompson face life in prison without the possibility of parole when they are sentenced on June 25.
